With all respect, I cannot agree that non-feasance does not come within the rule of Donoghue v Stevenson. The famous definition of "negligence" given by Alderson B in Blyth v Birmingham Waterworks Co (1856) 11 Exch 781 at 784 ; [156 ER 1047 at 1049] (and followed and developed in Overseas Tankship (UK) Ltd v Morts Dock & Engineering Co Ltd (The Wagon Mound) [1961] AC 388 at 426) includes omissions as well as acts. It was in the following terms: Negligence is the omission to do something which a reasonable man, guided upon those consid-erations which ordinarily regulate the conduct of human affairs, would do, or doing something which a prudent and rea-sonable man would not do. The defendants might have been liable for negligence, if, unintentionally, they omitted to do that which a reasonable person would have done, or did that which a person taking reasonable precautions would not have done.

Allt för ofta glöms dom stackars sköldpaddorna. Dessa faschinerade urtidsdjur får stå ut med allt för mycket trakasserier. Oftast verbal mobbing men även fysisk.

Allt för ofta har jag fått höra sköldpaddsskämt och nu har jag en gång för alla fått nog. Nu får det vara slut med trakasserierna mot sköldpaddorna. Låt oss en gång för alla gå ihop och verka för ett bättre miljö för dessa stackars djur. Och sluta upp med kränkade skämten!

Tigrar och jättepandor hotar sköldpaddorna i deras vardagliga liv. Dessa händelser hamnar jämt i skymundan och får knappt någon medial uppmärksamhet över huvudtaget. Visst, nån gång när en västerländsk padda blivit trakasserad så kan man läsa det i notis-spalterna i tidningen. Men de österländska paddorna ser man aldrig någonting om. Jag skulle vilja gå så långt och kalla detta för någon sorts rasism.

Vafan ute i världen finns sköldpaddor utan mat och ändock bryr sig folk bara om växthuseffekten. Det är så man skäms för att vara människa.
